Kross Inspectors does not provide legal advice, but we do play an important role working with defense attorneys within the process by providing supporting documentation in the defense of these law suits as well as helping business/property owners become compliant before their property becomes a subject of an ADA violation complaint. 

Our surveys include a four step process in order to properly submit documentation in support of your defense:

1. Physical Survey: We survey your property for accessible design in accordance with the most recent Standards published by the U.S. Department of Justice (2010).
   
2. Review “Not Readily Achievable For Barrier Removal”: Although the U.S. Department of Justice does not recognize “Grandfathering”, there are certain “tests” our firm can conduct in determining if correcting a noncompliant item is readily achievable. (A simple example is if an accessible restroom is not large enough for maneuvering and compliance requires major structural modifications, then that item may be considered “not readily achievable”.)
   
3. Issue Final Report: A Report indicating items requiring attention to become compliant with recommendations for modification from our Experts.
   
4. Verification of Corrections: Upon correction of features modified, our team will return in order to properly document as well as issue a Certificate of Compliance for posting at the business in order to prevent future law suits. (*Additional trip charges apply.)
